Terms of Service.
1. Acceptance
These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and HephaTech ("we", "us", "our") governing your use of the website at hephatech.in (the "Website"). The agreement is formed under the Indian Contract Act, 1872 by your continued use of the Website. If you do not agree, please stop using the Website.
This Website is a marketing and signup surface only. It does not provide a paid product or service; the launch list is a free, optional notification feature.
2. Eligibility
You may use the Website only if you are at least 18 years of age or are using it under the supervision of a parent or legal guardian, and only if you are competent to contract under §11 of the Indian Contract Act, 1872.
3. What we provide
The Website offers:
- Information about HephaTech and our open product offerings (GrowBit, StatusLoop, Hepha Works)
- A launch-list signup form to be notified when our main product becomes available
- Outbound links to our subdomain product sites and to public profiles
Our open products are governed by their own terms of service available at their respective subdomains. Subscribing to the launch list does not create an obligation on us to launch on any particular date or to launch at all.
4. Your obligations
You agree not to:
- Use the Website in violation of any law or regulation, including the Information Technology Act, 2000
- Submit false personal information, including a false email or one belonging to another person without authorisation
- Attempt to interfere with the security, availability, or integrity of the Website (including scraping, denial-of-service attacks, or automated submission of forms)
- Reverse-engineer, decompile, or attempt to extract source code from the Website
- Use the Website to transmit malware, defamatory, obscene, or otherwise unlawful content
You are solely responsible for any submission you make through the Website, and you grant us a non-exclusive, worldwide, royalty-free licence to use any feedback you provide to improve our products.
5. Intellectual property
All content on the Website — including text, design, source code, graphics, logos, and the HephaTech name — is the intellectual property of HephaTech or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable international treaties. You may not copy, modify, distribute, or create derivative works without our prior written consent, except for fair-use viewing in the ordinary course of browsing.
6. Third-party services
The Website integrates a small number of third-party services for delivery and operation, including Vercel (hosting), Formspree (form delivery), and Google Fonts (typography). When you interact with the Website you also interact with those services on their terms. We do not control them and are not responsible for their conduct, but we have selected them after a reasonable review of their security and privacy practices.
7. Disclaimers
The Website is provided "as is" and "as available". To the maximum extent permitted by Indian law, we disclaim all express and implied warranties, including (without limitation) merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of malicious code, although we take reasonable measures to ensure both.
Nothing in this section excludes or limits any statutory consumer rights you have under the Consumer Protection Act, 2019 or any other Indian law that cannot lawfully be excluded.
8. Limitation of liability
To the maximum extent permitted by law, HephaTech and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website, including loss of profits, data, business, or goodwill, even if we have been advised of the possibility of such damages.
Where liability cannot be excluded as a matter of law, our total aggregate liability arising out of or in connection with the Website is limited to INR 1,000 or the equivalent in any other currency.
9. Indemnification
You agree to indemnify and hold HephaTech harmless from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your violation of any law or any rights of a third party, or (c) any content you submit through the Website.
10. Termination
We may suspend or terminate your access to the Website at any time, with or without notice, if we reasonably believe you are in breach of these Terms or are misusing the Website. You may stop using the Website at any time. The provisions on intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution survive termination.
11. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to §12 below, the courts at [Jurisdiction city], India have exclusive jurisdiction over any matter not resolved by arbitration.
12. Dispute resolution
Any dispute, controversy, or claim arising out of or relating to these Terms — including their breach, termination, or invalidity — will first be addressed by good-faith discussion.
